Terms of service

These Terms of Service ("Terms") apply when you use northdusk.com or buy from Northdusk ("we", "us"). Northdusk is operated by a sole proprietorship registered in Finland (business ID 3618254-7). By using the site or placing an order, you agree to these Terms. Please read section 13: it requires disputes to be resolved by individual arbitration and waives class actions, unless you opt out.

1. Using the site

You must be at least 18, or use the site with a parent or guardian's involvement. You agree not to misuse the site, including by interfering with its security or operation, scraping it, placing fraudulent orders or using it for anything unlawful.

2. Products

We describe our products as accurately as we can. Colors may look slightly different on your screen. Some lifestyle images on the site are digitally created or edited to show how the product is used.

Our sleep masks are general wellness products. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or sleep disorder. If you have ongoing trouble sleeping, talk to a doctor.

3. Prices and payment

Prices are in US dollars. Shipping costs are shown on the product page and at checkout before you pay. We accept the payment methods shown at checkout. If a product is listed at the wrong price because of an error, we may cancel the order and refund you in full, even after you receive a confirmation.

4. Orders

Your order is an offer to buy. A contract forms when we ship your order. We may limit quantities or refuse or cancel an order, for example if we suspect fraud or resale, or if an item is unavailable. If we cancel after you've paid, we refund you in full.

5. Promotions

Offers such as the 2-pack price apply as described on the site, can't be exchanged for cash and can't be combined with other offers unless we say so.

6. Shipping

We ship to US addresses only. Delivery times, costs, duties and what happens if an order is lost are set out in our Shipping policy. Risk of loss passes to you when your order is delivered.

7. 60-night trial and refunds

Our 60-night trial, replacements for damaged items and cancellations are described in our Refund policy.

8. Intellectual property

The site and its content, including the Northdusk name and logo, text, images and video, belong to us or our licensors. You may view the site for personal, non-commercial use. You may not copy, reproduce or reuse its content without our written permission.

9. Third-party services

Checkout, payments and delivery are provided by third parties such as Shopify, our payment processors and carriers, under their own terms. The site may link to other websites; we're not responsible for their content.

10. Disclaimer

Except as stated in our Refund and Shipping policies, the site and our products are provided "as is" and, to the extent the law allows, without other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states don't allow these exclusions, so they may not apply to you.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, and our total liability for any claim relating to a product or order is limited to the amount you paid for it. Nothing in these Terms limits liability that can't be limited by law, such as liability for fraud or for death or personal injury caused by negligence.

12. Indemnity

If you breach these Terms or misuse the site, you agree to cover reasonable losses and costs we incur as a result, to the extent the law allows.

13. Dispute resolution and arbitration

Talk to us first. Most problems can be solved by email. Before starting any claim, you agree to email support@northdusk.com with a description of the issue and give us 60 days to resolve it. We'll do the same if we have a claim against you.

Arbitration. If we can't resolve it, you and we agree that any dispute relating to the site, our products or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration may be held by video, by phone or on written submissions. We will pay the AAA filing, administration and arbitrator fees to the extent the AAA Consumer Rules require. The arbitrator may award the same individual relief a court could.

Exceptions. Either of us may bring an individual claim in small claims court if it qualifies, and either of us may go to court over misuse of intellectual property.

No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding. If this class waiver is found unenforceable for a claim, that claim will proceed in court and not in arbitration.

Opting out. You can opt out of this section by emailing support@northdusk.com within 30 days of your first purchase with your name and the words "arbitration opt-out". Opting out doesn't affect the rest of these Terms.

14. Governing law

These Terms are governed by the Federal Arbitration Act, applicable US federal law and the laws of the State of Delaware, without regard to conflict-of-law rules. This doesn't take away any protection you have under the consumer protection laws of the state where you live.

15. Changes and general terms

We may update these Terms. Changes apply to orders placed after the date at the top. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. You may not transfer your rights under these Terms; we may transfer ours to a successor. These Terms, together with our Shipping, Refund and Privacy policies, are the entire agreement between you and us.
